Responsibilities:
• Primary focus is to assess liabilities and advise the Corporation on a wide variety of remediation issues arising under various federal and state statutory authorities including CERCLA, RCRA, TSCA (PCB regulations) and Pennsylvania Act 2 (Brownfields) for formerly and currently owned company locations and third party sites.
• Lead litigation at both the state and federal level attendant to new and existing environmental sites.
• Interact and negotiate with federal, state and local regulatory agencies (in particular, USEPA, OSHA, PADEP and NYDEC), the Department of Justice, and various state attorney general offices.
• Lead and respond to CERCLA 104(e) information requests and similar type information requests from state agencies.
• Negotiate contracts, property sales agreements, settlement agreements and consent decrees regarding environmental matters.
• Provide environmental legal advice on acquisitions, divestitures, mergers, and real estate transactions.
• Review and evaluate federal, state, and local regulations which could affect the Corporation.
Basic Qualifications:
• At least 8 years of legal experience in environmental law and litigation. Practice in a corporate setting a plus
• JD required
Additonal Qualifications:
• Licensed in Pennsylvania preferred
• Significant experience and depth of knowledge with remediation under CERCLA, RCRA, the TSCA PCB regulations and Pennsylvania Act 2 (Brownfields).
• Significant experience in negotiating judicial consent decrees, consent agreements and settlement agreements at both the federal and state level.
• Negotiation experience with EPA and state agencies in responding to and resolving regulatory issues and citations.
• Excellent oral and written communication skills.
