Overview
What is the role
Awarded ‘Channel of the Year’ at the Broadcast Awards and RTS Awards in 2020 and part of ViacomCBS, you’ll be part of the Channel 5 success story which continues to grow, increasing the quality of its original content. This role leads the team responsible for all Business Affairs aspects of commissioning original programmes primarily intended for Channel 5 and its portfolio of channels. Also includes responsibility for commissions and acquisitions across Channel 5’s kids brand Milkshake! and other areas as the business demands.
Leadership
• Responsible for the leadership and management of a team of 7 (4 lawyers, 2 Paralegals and a Team Assistant) and the BA Commissions team who are responsible for drafting and negotiating all standard Production Agreements within the framework of Pact agreed Terms of Trade for main channel commissions and non-standard commissions for the portfolio of channels.
• Accountable for the teams' input into key contracts ensuring a high threshold of accuracy and efficiency is maintained throughout
• Ensure meaningful and regular 1 to 1 are had with direct reports and supporting the team in their development
• Lead by example and support the team with tasks as required
• Lead on more complex agreements e.g. financing agreements, bespoke and/or high profile or value projects, input into potential litigious matters with Content Legal Advice.
• Managing key or ongoing deals and leading/supervising direct reports’ work on key deals.
• Maintaining a flow of less complex agreements to help the team manage workload.
Process
• Reviewing processes and making appropriate changes, to ensure efficiency, priorities; and empowering the team to drive improvements
• Collaborate the other ViacomCBS brands to seek consistency of terms.
• Ensuring the team accurately record rights, input into right management system (Whats On).
• Overseeing rights clearance and other projects managed by the team e.g. clearing rights for ViacomCBS’s AVOD services Pluto, More Milkshake!, Noggin and third party platforms.
Corporate & Strategic
• Inputting into corporate projects such as audits, SOX compliance, tax, content sharing etc.
• Discussing and advising on matters such as rights management with other departments across ViacomCBS globally. Input into business initiatives e.g. GDPR, IR35, Diversity.
Risk Management
• Identifying areas of risk and advising the business on steps to mitigate
• Working with the VP/GC and also SVP of Government Relations and other teams, as required, acting as the Business Affairs lead on Ofcom quotas (e.g. originations, made outside of London)
• Working closely with other teams to ensure accurate Ofcom reporting
• Chair the internal Ofcom quota review meetings
Union Agreements/Societies/Industry Relations
• Acting as the Lead lawyer on Pact Terms of Trade negotiations and industry matters and representative for various rights unions/work groups e.g. Directors UK, Equity and Directors UK Broadcaster working group
What skills do you need
• A UK qualified lawyer with a minimum of 10 Years PQE specialising in TV/media
• Experience in leading, developing and managing a team in a similar role and environment
• Ideally have experience in working for a Public Service Broadcaster, or working on deals with PSBs under Pact Terms of Trade.
• Experience of other areas of media, distribution, commercial contracts to bring to the table
• Experience of rights management, systems and processes and knowledge of Ofcom PSB quotas would be an advantage
• Excellent negotiating and drafting skills with strong attention to detail
• Ability to work to deadlines and deliver an effective service to the business and influence and be adaptable to changing situations
• Ability to think through problems, identify the issues and provide creative solutions and to identify issues to refer up to senior management.
• Proven experience in confidently providing commercial and legal advice whilst building and maintain long term business relationships, both internally and externally
